Can I counter sue my mortgage and note holder if they did anything wrong during foreclosure proceedings?

It really just depends on what you mean by “did anything wrong”. Plaintiffs in foreclosure actions make legally detrimental mistakes very often. They may make a statutory or procedural error, which can lead to disposing of their case against you. Or, they make, for example, violate your rights under the Federal/Florida Fair Debt Collections Practices Act, among other regulations / laws.

So, the answer to your questions is… yes. You may be able to bring an action against a Plaintiff in a foreclosure suit depending on the circumstances. If you want to give me a call, I can give you much more specific advice based on your unique circumstance.
